Privacy Notice

The General Data Protection Regulation (GDPR) is a European Union (EU) law which regulates the collection, use, disclosure and processing of personal information of individuals in the EU. The GDPR replaces previous existing European legislation.

In accordance with the Data Protection (Charges and Information) Regulations 2018, Pet Consultant Limited is a registered company with the Information Commissioner’s Office (ICO: the UK’s independent authority set up to uphold information rights in the public interest) and complies with all relevant data protection legislation. The following Privacy Notice is intended to provide transparency about how we handle your personal data.

1. Who we are:

Under regulations outlined by the ICO, the data controller of Pet Consultant Limited is Dr Candy d’Sa. The processing of personal data is governed and regulated by the GDPR.

2. Your personal data:

Personal data relates to an individual who can be identified from that data, either from the information itself or in conjunction with any other information in the data controller’s possession or likely to come into such possession. Your personal data is collected and processed for the provision of services requested.

3. How do we use your personal data?

In order to carry out the provision of services for Pet Consultant Limited, we will use your personal data to:

(a) carry out consultancy services relating to animal behaviour and training for animal owners and keepers, referring veterinary surgeons and local authorities;

(b) carry out consultancy services relating to animal behaviour and training as a legal expert witness for solicitors, local authorities, child adoption/fostering agencies, police forces and the Crown Prosecution Service;

(c) administer internal client records; and

(d) administer our own accounts.

4. How is your personal data processed?

Only personal data relevant to the services requested is collected. Your personal data is protected from loss, misuse, unauthorised access and disclosure.

5. With whom may your personal data be shared?

Your personal data will remain confidential and will only be shared with individuals and/or organisations with your permission in order to carry out the services requested, or if required to do so in law. Depending on the services requested, the individuals/organisations may include your veterinary surgeons and veterinary practice staff, your pet insurance companies, legal representatives, local authorities with a specific and authorised interest in the service we are providing, police forces and the Crown Prosecution Service. We do not share your personal data with third parties for marketing purposes. Pet Consultant Limited does not use social media in its business activities.

6. The lawful bases for processing your personal data

Under the GDPR, we must have a lawful basis for processing your personal data. We have reviewed the purposes of our processing activities, and selected the most appropriate lawful bases.

These bases are:

(a) [For 3 (a) above]: Consent has been given to process personal data for the specific purpose of animal behaviour consultancy services.

(b) The processing is necessary for a contract the data controller has with the data subject, or because the data subject has asked the data controller to take specific steps before entering into a contract.

(c) The processing is necessary to comply with the law.

(d) The processing is necessary to perform a task in the public interest or for official functions, and the task or function has a clear basis in law.

(e) The processing is necessary for legitimate interests or the legitimate interests of a third party unless there is a good reason to protect the personal data which overrides those legitimate interests.

7. Criminal offence data

There are separate safeguards for personal data relating to criminal convictions and offences, set out in Article 10. The lawful bases remain as above, and we also comply with Article 10.

We will process the data in our official capacity as an Expert Witness on instruction and authorisation from solicitors or police forces/Crown Prosecution Service. We do not keep a register of criminal convictions.

8. How long do we keep your personal data?

Personal data will be stored for seven years from last contact. In the event of death, this period will be seven years from the date of death. Personal data of minors will be kept for seven years after their 18th birthday.

9. Your rights

The GDPR provides you with the following rights:

(1) The right to be informed about the collection and use of your personal data;

(2) The right to access your personal data. Requests for such data will be responded to within one month.

(3) The right to have any inaccurate or incomplete personal data rectified. Requests for such data will be responded to within one month.

(4) The right, under certain circumstances, to have your personal data erased. Requests for such data will be responded to within one month.

(5) The right, under certain circumstances, to request the restriction or suppression of your personal data.

(6) The right to data portability allowing you to obtain and reuse the personal data you have provided, for your own purposes across different services.

(7) The right, under certain circumstances, to object to the processing of your personal data.

10. Third parties:

We endeavour to take all reasonable steps to protect your personal information. We offer the industry standard security measures available through your browser (Secure Socket Layer, SSL encryption). However, we cannot guarantee the security of any data that you disclose online and we will not be responsible for any breach of security unless this is due to our negligence or wilful default.

All JotForm stand-alone form links and embed codes are secure (SSL) by default. JotForm also adheres to strict European data protection laws – any data obtained by Pet Consultant Limited is stored on secure servers (using an EU Safe Form served from JotForm’s European servers in Germany). When the form data is submitted the data can only be accessed from JotForm’s European site.
